Terms of Service
Last updated 11 September 2026
1. These terms
These terms govern your use of the Real Estate Intelligence Platform (“the Platform”), operated by Fiord AI Limited, a New Zealand company (“Fiord AI”, “we”, “us”). By signing in you agree to them. If your agency has a separate signed agreement with us, that agreement takes priority where the two conflict.
2. Accounts
Accounts are issued to a named person at a subscribing agency. Keep your credentials to yourself — you are responsible for what happens under your login. Tell us promptly at hello@fiord.ai if you think an account has been compromised.
An agency’s account owner can add, suspend and remove users in their own workspace. We may suspend an account that is being used in breach of these terms or in a way that threatens the service or other customers.
3. Your data, and what you promise about it
You keep ownership of the contact lists, recordings, transcripts and other data you put into the Platform. You grant us the licence we need to host and process it in order to run the service for you.
By uploading contacts you confirm that:
- you have a lawful basis to contact those people;
- you have checked them against any do-not-call register that applies to you, and you will honour every opt-out the Platform records; and
- you will comply with the Privacy Act 2020, the Unsolicited Electronic Messages Act 2007, the Real Estate Agents Act 2008 and its rules of conduct, and any equivalent law in the places you call.
You must not use the Platform for unsolicited bulk marketing to people who have not consented or with whom you have no existing relationship, to impersonate anyone, or to harass.
4. AI-assisted calling
The Platform places calls using a synthetic voice. The assistant identifies itself as an AI assistant calling on behalf of your agency at the start of every call. You must not configure it to claim to be a human.
Calls may be recorded and transcribed. Where the law where you are calling requires notice or consent to record, ensuring that happens is your responsibility.
AI output is a starting point, not advice. Call summaries, scores, matches and property facts are generated automatically and can be wrong. Check anything material before you act on it or repeat it to a client. Nothing the Platform produces is legal, financial or valuation advice.
5. Connected calendars
If you link a Google or Microsoft calendar, you authorise the Platform to read your busy times and to create, update and cancel the appointments it books for you. It will not modify any other event. You can disconnect at any time in Settings, or revoke access from your Google or Microsoft account. Our handling of that data is set out in the Privacy Policy.
6. Fees
Subscription fees, call charges and credit pricing are set out in your agency’s order. Usage-based charges — connected calls, unanswered attempts, enrichment — are metered by the Platform and billed in arrears. Invoices are due on the terms stated on them. We may pause service on an account that is materially overdue after giving notice.
7. Availability
We aim to keep the Platform available at all times but we do not guarantee uninterrupted service. We rely on third parties — telephony, model providers, hosting — and their outages will affect us. We will give reasonable notice of planned maintenance where we can.
8. Our intellectual property
The Platform, including its software, prompts, models and interfaces, remains ours. You get a non-exclusive, non-transferable right to use it while your subscription is current. You must not copy, resell, reverse engineer or build a competing product from it.
9. Liability
Nothing in these terms limits rights that cannot legally be limited. Where you use the Platform in trade, the Consumer Guarantees Act 1993 does not apply.
To the extent the law allows, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data. Our total liability in any 12-month period is limited to the fees you paid us in that period.
You are responsible for how you use what the Platform produces, including any contact made with a person on a list you loaded.
10. Ending the agreement
Either party may end the agreement on the notice period in the agency’s order, or immediately for material breach that is not fixed within 14 days of being pointed out. On termination we will make your data available for export for 30 days, then delete it in line with the Privacy Policy.
11. Changes
We may update these terms. We will tell account holders by email at least 30 days before a material change takes effect. Continuing to use the Platform after that means you accept the change.
12. Law
These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.
